I read an article recently from an attorney who represented the Buyer of a new condo who was awarded their Earnest Money back including attorneys fees. I can’t really take any ethical stance on this matter, except to say that a deal is a deal…unless either party defaults or fails to perform on the agreed terms of the deal.
